REEDY RIVER BOX LACROSSE LEAGUE
 

PLAYER PARTICIPATION, ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNIFICATION AGREEMENT

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE SIGNING. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING A CLAIM OR LAWSUIT.
 

This Player Participation, Assumption of Risk, Release of Liability, and Indemnification Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) in favor of Reedy River Box Lacrosse League, together with its owners, organizers, administrators, directors, officers, employees, coaches, referees, officials, volunteers, agents, representatives, sponsors, affiliates, and any other persons or entities acting on behalf of or in connection with the League (collectively, the “Released Parties”).
 

1. PARTICIPATION IN BOX LACROSSE

Participant desires to participate in organized box lacrosse activities conducted by or through the Reedy River Box Lacrosse League (“League Activities”), including, without limitation:

  • League games and contests;

  • Practices, training sessions, clinics, and tryouts;

  • Warm-ups, conditioning, drills, and other athletic activities;

  • Tournaments, scrimmages, and exhibition games;

  • Travel to and from League Activities when arranged, sponsored, or facilitated by the League;

  • Use of athletic facilities, locker rooms, playing surfaces, equipment, and related areas; and

  • Any other activity reasonably associated with participation in the League.

Participant understands that box lacrosse is a physically demanding and inherently competitive contact sport.
 

2. ACKNOWLEDGMENT OF RISKS

Participant understands and acknowledges that participation in box lacrosse involves inherent and other risks of injury, including, but not limited to:

  • Bruises, cuts, abrasions, and lacerations;

  • Sprains, strains, and torn ligaments;

  • Dislocations and fractures;

  • Concussions and other head injuries;

  • Neck, spinal, and back injuries;

  • Muscular, tendon, and joint injuries;

  • Dental and facial injuries;

  • Heat-related illness, dehydration, or exhaustion;

  • Cardiac or other medical events;

  • Permanent disability;

  • Paralysis;

  • Traumatic brain injury;

  • Emotional or psychological injury; and

  • In extreme circumstances, death.

Participant understands that injuries may result from physical contact with other players, sticks, balls, boards, goals, playing surfaces, equipment, officials, spectators, or other objects or persons.

Participant further understands that injuries may result from the actions or omissions of Participant, other players, coaches, referees, League personnel, facility personnel, spectators, or other persons, as well as from conditions of the premises, playing surface, equipment, or facilities.

Participant voluntarily chooses to participate in League Activities despite these risks.
 

3. ASSUMPTION OF RISK

Participant knowingly and voluntarily assumes all risks of injury, illness, disability, property damage, and death associated with or arising from participation in League Activities, including risks that are known or reasonably foreseeable and risks that may be inherent in the sport of box lacrosse.

Participant understands that no representation or guarantee has been made that League Activities, facilities, playing surfaces, equipment, or conditions will be free from hazards or risks of injury.
 

4. RELEASE AND WAIVER OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Participant hereby releases, waives, discharges, and covenants not to sue the Released Parties for claims, demands, causes of action, damages, losses, expenses, or liabilities arising out of or relating to Participant’s participation in League Activities.

This release specifically includes claims arising from the ordinary negligence of a Released Party, including claims based upon the acts or omissions of the League, its organizers, coaches, referees, officials, volunteers, employees, agents, or representatives, to the extent such release is permitted by applicable law.

Participant understands and acknowledges that this provision is intended to expressly release claims based upon the ordinary negligence of the Released Parties and is not merely a general release of unknown claims.
 

5. LIMITATIONS OF RELEASE

Nothing in this Agreement shall be interpreted as releasing, waiving, or limiting any liability that cannot lawfully be released or waived under applicable law.

Without limiting the foregoing, this Agreement is not intended to release liability to the extent prohibited by applicable law, including liability arising from conduct that applicable law does not permit a party to waive or release in advance.

If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
 

6. MEDICAL TREATMENT AUTHORIZATION

Participant authorizes League personnel, coaches, officials, volunteers, or other responsible persons to obtain reasonable emergency medical assistance for Participant if Participant is injured or becomes ill during a League Activity and, in the judgment of such person, medical attention is reasonably necessary.

Participant understands and agrees that the League does not guarantee the availability of medical personnel, athletic trainers, emergency medical services, or other medical resources at every League Activity.

Participant understands that all medical expenses incurred as a result of an injury or illness are the responsibility of Participant and/or Participant’s parent or legal guardian, as applicable, unless otherwise required by law or expressly covered by a separate insurance policy.
 

7. INSURANCE

Participant understands that the League does not represent or guarantee that medical, accident, disability, or other insurance coverage will be provided to Participant.

Participant is responsible for determining whether Participant has adequate insurance coverage for participation in box lacrosse and for satisfying any applicable insurance requirements.
 

8. PLAYER RESPONSIBILITY

Participant agrees to:

  1. Follow all League rules, facility rules, game rules, and safety instructions;

  2. Follow the reasonable instructions of coaches, referees, officials, and League personnel;

  3. Use required protective equipment properly;

  4. Immediately report injuries, symptoms of concussion, or other medical concerns to an appropriate League representative;

  5. Refrain from participating when Participant believes participation would create an unreasonable risk to Participant or others; and

  6. Conduct himself/herself/themselves in a safe and sportsmanlike manner.

Participant understands that failure to follow League rules or safety instructions may result in removal or suspension from League Activities.
 

9. EQUIPMENT

Participant acknowledges that proper protective equipment is important to reducing, but cannot eliminate, the risk of injury.

Participant is responsible for ensuring that personally owned equipment is properly fitted, maintained, and appropriate for participation.

The use of protective equipment does not guarantee that Participant will not suffer an injury.
 

10. INDEMNIFICATION

TO THE FULLEST EXTENT PERMITTED BY LAW, Participant agrees to indemnify and hold harmless the Released Parties from claims, damages, losses, liabilities, costs, and reasonable expenses arising from:

(a) Participant’s intentional or negligent acts or omissions;

(b) Participant’s violation of League or facility rules; or

(c) claims brought by another person arising from Participant’s conduct or participation in League Activities,

except to the extent such indemnification is prohibited by applicable law.
 

11. FACILITY AND THIRD-PARTY RESPONSIBILITY

Participant understands that League Activities may take place at facilities owned, operated, leased, or controlled by third parties.

The League does not necessarily own or control the facilities in which League Activities occur.

Participant acknowledges that facility conditions, equipment, playing surfaces, and activities of third parties may present risks independent of the League.

Nothing in this Agreement is intended to release a third party from liability that cannot legally be released or waived.
 

12. NO GUARANTEE OF PARTICIPATION

Participant understands that registration with the League does not guarantee participation in every game, contest, practice, tournament, or other League Activity.

The League reserves the right to modify schedules, locations, rules, rosters, or participation requirements as reasonably necessary.
 

13. VOLUNTARY PARTICIPATION

Participant represents that participation in League Activities is voluntary.

Participant has had the opportunity to ask questions regarding the nature and risks of box lacrosse and has had adequate opportunity to review this Agreement before signing.

Participant acknowledges that no person has forced, coerced, or improperly pressured Participant into signing this Agreement or participating in League Activities.
 

14. ACKNOWLEDGMENT OF UNDERSTANDING

Participant acknowledges that:

  • Participant has carefully read this Agreement;

  • Participant understands its contents;

  • Participant understands that this Agreement contains a release and waiver of legal claims;

  • Participant understands that Participant may be giving up the right to bring certain claims against the Released Parties;

  • Participant understands the risks associated with box lacrosse;

  • Participant voluntarily accepts those risks; and

  • Participant signs this Agreement freely and voluntarily.
     

15. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflict-of-law principles, to the extent permitted by applicable law.

Any dispute concerning the interpretation or enforceability of this Agreement shall be determined in accordance with applicable South Carolina law.
 

16. SEVERABILITY

If any provision of this Agreement is determined by a court of competent jurisdiction to be invalid, unenforceable, or contrary to law, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall remain in effect to the fullest extent permitted by law.
 

17. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between Participant and the Released Parties concerning the subject matter addressed herein and supersedes any prior oral or written representations concerning the release, waiver, assumption of risk, or indemnification addressed by this Agreement.

Any modification to this Agreement must be made in writing and authorized by the League.
 

PARTICIPANT ACKNOWLEDGMENT AND SIGNATURE

I, the undersigned Participant, have read and understand this Player Participation, Assumption of Risk, Release of Liability, and Indemnification Agreement.
 

I understand that by signing this Agreement, I am voluntarily assuming risks associated with participation in box lacrosse and releasing certain claims against the Reedy River Box Lacrosse League and the other Released Parties, including claims arising from ordinary negligence to the extent permitted by applicable law.
 

I understand that I am encouraged to seek independent legal advice before signing this Agreement if I have questions regarding its meaning or legal effect.

I have carefully reviewed this Agreement and understand its terms. I consent to the Participant’s participation in Reedy River Box Lacrosse League Activities and acknowledge the risks associated with participation in box lacrosse.

To the fullest extent permitted by applicable law, I agree to the terms of this Agreement on behalf of myself and, where legally permissible, the Participant.
 

I further agree that the Participant and I will comply with the League’s rules and requirements.
